Top Cases Under the UTC

About the Program

The Uniform Trust Code, originally approved in 2000, has since been enacted in over 30 states. A large body of caselaw interpreting the UTC has also developed. This program, presented by the Reporter for the UTC, will discuss key cases that have arisen in Missouri and other states that of most significance for the drafting and administration of trusts.

About the Speaker

DAVID M. ENGLISH is the William Franklin Fratcher Missouri Professor of Law & Edward L. Jenkins Professor of Law at the University of Missouri School of Law. Professor English is best known for his work for the Uniform Law Commission. He was the Reporter (principal drafter) for the 2000 Uniform Trust Code, the 1993 Uniform Health-Care Decisions Act, and the 2007 Uniform Adult Guardianship and Protective Proceedings Jurisdiction Act. Professor English is also the former Chair of the ABA Section of Real Property, Trust & Estate Law, a former Chair of the ABA Commission on Law and Aging, and former Chair of the Probate and Trust Committee of the Missouri Bar.  

In addition to numerous law review and professional articles, Professor English is co-author of the treatises Wills, Trusts, and Estates, and Wills, Trusts, and Estates Concise Edition published by West Academic, co-author of Tax, Estate and Financial Planning for the Elderly, and Tax, Estate and Financial Planning for the Elderly, published by Lexis, and co-author of Fiduciary Accounting and Trust Administration Guide, published by ALI-ABA.

Prior to entering law teaching, Professor English was a partner in the Chicago Law firm of D’Ancona & Pflaum. He received his B.A. from Duke University and his J.D from Northwestern University.
